Gregory B. Collins has experience prosecuting and defending all aspects of business and intellectual property litigation. Mr. Collins represents regional and national corporations, Arizona-based businesses and individuals in breach of contract actions, business tort suits, and trademark, copyright and patent infringement matters. He has represented clients in all phases of the litigation process, including as lead counsel at trial and arbitration.

Mr. Collins’ intellectual property practice includes trademark, copyright and patent infringement actions in federal district court. He has also represented businesses in Trademark Trials and Appeals Board proceedings and participated in International Trade Commission investigations. Mr. Collins has obtained injunctive and permanent relief in trademark infringement and unfair competition actions and successfully defended and prosecuted patent infringement and false advertising claims.

Mr. Collins represents clients in broad array of business disputes. He has successfully litigated complex commercial litigation matters and real-estate disputes and has prosecuted and defended all types of Internet law claims. He recently published an article in the Creighton Law Review, Of “Purposes Not Prohibited,” New Federal Rule of Evidence 408(b), Co-Author, 40 CREIGHTON L. REV. 679 (June 2007). He has presented continuing legal education on obtaining injunctive relief in both state and federal court.

Before joining Kercsmar & Feltus, Mr. Collins practiced commercial and intellectual property litigation at Snell & Wilmer, LLP, the largest law firm in the Southwest.

  • Successfully defended anonymous authors of blogspace against trademark infringement and dilution claims brought by national hotel chain.
  • Represented a real-estate investor in his efforts to challenge covenants and restrictions.
  • Obtained preliminary and permanent injunctive relief on behalf of national cell phone company in its claims against competitors alleging contributory trademark infringement and unfair competition.
  • Defended a limited liability company that purchased land at public auction in a suit challenging the validity of the auction.
  • Represented a group of physicians in their efforts to enforce rights under their limited liability company’s operating agreement.
  • Successfully represented individual investors in arbitration against one of the largest condominium developments in Maricopa County.
  • Represented Arizona based business in its defense of Lanham Act false advertising claims brought by competitor.
  • Defended a publicly traded company in multi-jurisdictional litigation against a patent troll.
  • Successfully obtained temporary and permanent injunctions in favor of a Fortune 500 company barring competitors from misappropriating trademarks.

Community Involvement

In addition to his commercial and intellectual property practice, Mr. Collins has devoted considerable time to representing clients in pro bono matters. His pro bono practice includes representation of plaintiffs in prisoner rights litigation and mortgage fraud litigation.

Mr. Collins is a member of Scottsdale Chamber of Commerce, the Maricopa Bar Association’s Technology & Intellectual Property division and the Arizona Bar Association’s Committees on Intellectual Property and Trial Practice.

Personal

Mr. Collins is from Tucson, Arizona. He met his wife, a native Phoenician, while attending law school at the University of Arizona. Mr. Collins is an Arizona Cardinals season ticket holder and an avid football fan.
